1. Acceptance of Terms

By accessing or playing Factrix ("the Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Game.

2. Eligibility

You must be at least 13 years old to create an account and play Factrix. If you are under 18, you represent that you have your parent or guardian's permission to use the Game. By using the Game, you represent and warrant that you meet these requirements.

3. Account Registration

To play Factrix, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Game Rules and Fair Play

When playing Factrix, you agree to:

  • Play fairly and not exploit bugs or glitches
  • Not use cheats, automation, bots, or hacks
  • Not interfere with other players' enjoyment of the Game
  • Report bugs and exploits rather than abuse them
  • Respect other players in multiplayer interactions

5. User Conduct

You agree not to:

  • Harass, threaten, or abuse other players
  • Use offensive, discriminatory, or inappropriate usernames or content
  • Impersonate other players or Factrix staff
  • Spam, advertise, or promote external services
  • Attempt to access other players' accounts
  • Engage in real-money trading of in-game items (unless officially supported)
  • Reverse engineer, decompile, or modify the Game

6. Intellectual Property

All content in Factrix, including but not limited to graphics, artwork, game mechanics, music, code, and text, is owned by Factrix or its licensors and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to play the Game for personal, non-commercial purposes. This license does not include the right to:

  • Modify or create derivative works
  • Distribute or publicly display Game content
  • Use Game content for commercial purposes
  • Remove any proprietary notices or labels

7. User-Generated Content

Your factories and game progress are stored on our servers. By creating content in the Game, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Game.

You retain ownership of your creative decisions, but we may use aggregate or anonymized data about gameplay for analytics and improvements.

8. Virtual Items and Currency

The Game may include virtual items, cards, or currency. These items have no real-world value and cannot be exchanged for real money. We reserve the right to modify, remove, or adjust virtual items at any time.

Any purchases of virtual items are final and non-refundable, except as required by law or as described in our Refund Policy.

9. Service Availability

We strive to keep Factrix available 24/7, but we do not guarantee uninterrupted access. The Game may be unavailable due to:

  • Scheduled maintenance
  • Emergency updates or fixes
  • Technical issues beyond our control
  • Force majeure events

We are not liable for any loss of progress or data due to service interruptions.

10. Termination

We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or for any other reason at our discretion. Upon termination:

  • Your license to use the Game is revoked
  • You lose access to your account and game data
  • Any virtual items or currency are forfeited

You may also delete your account at any time through your account settings.

11. Disclaimers

THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Game will be error-free, secure, or available at any particular time.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACTRIX AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability for any claims arising from these Terms or the Game shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Factrix and its affiliates from any claims, damages, or expenses arising from your use of the Game, violation of these Terms, or infringement of any third-party rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or the Game shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in courts of competent jurisdiction.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-game notification. Continued use of the Game after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
